Thank you for choosing to book with Nantseren. When you make a booking you are entering an agreement with us on the terms and conditions ("Terms") set out below.
It is the responsibility of the person making the booking to ensure that each Group Guest has read, accepts and will adhere to these Terms and will observe and comply with all relevant instructions and safety information provided to them before and during their Holiday. Copies of these will be placed in the Barn and within each Tent. The person making the booking is also required to agree to the hot tub and wood burning stove disclaimer on or before arrival on behalf of all Group Guests before use of these is permitted.
We welcome children at Nantseren, but any child under 18 must be accompanied by an adult who will take responsibility for that child, and assume responsibility for that child’s compliance with these Terms.
Definitions
“Accommodation”: includes the Tents, the Barn, the Communal Kitchen, the Bathrooms, the Wild Spa Area, the designated Group Guest car parking area and any other facility designated for use by the Group Guests.
“Barn”: the communal barn which contains the Communal Kitchen and Bathrooms.
“Bathroom(s)”: the bathrooms within the Communal Barn.
“Booking(s)”: the booking made in accordance with clause 1 below and these Terms.
“Booking Start Date”: the first day of the Holiday.
“Communal Kitchen”: situated within the Barn.
“Deposit”: 25% of the Price, payable at the time the Booking is made and non refundable.
”Guest”: “You” or “Your”: the person who makes the booking.
“Group Guest”: Any member of the party who are included in the booking including You.
“Holiday”: the period of time covered by the Booking.
“Nantseren Meadow”: the field on which the Tents are sited.
“Price”: The price agreed in the Booking and includes the charge for your use of the Accommodation, all bedding, duvets, sheets and towels, excluding beach towels, plus any additional extras chosen at the time of the Booking.
Tent/Tents: the four tents sited on the Nantseren Meadow for use by the Group Guests.
“Terms”: Nantseren’s Terms and Conditions set out below, and accepted by you when making the Booking.
“We, “Our” or “Us”: the Owners of Nantseren.
“Wild Spa”: the designated wild spa area which includes the hot tub.
1. Booking
a) You must be over 21 years of age to make a Booking, We are required to keep a record of names and home addresses of all Group Guests. Your name, address, email and phone number must be provided on booking which can be done either online or by email; names and addresses for Group Guests must be confirmed by email up to 14 days before arrival.
b) A non refundable Deposit of 25% is to be paid at the time the Booking is made. At this point your holiday is considered confirmed.We accept payment by Paypal, card or bank transfer.
c) The balance of the Price is payable by Paypal, card or bank transfer not less than 8 weeks prior to the start of the Holiday. An email reminder will be issued.
d) Bookings made less than 56 days prior to the arrival date must be paid in full at the time of the Booking.
e) Any Booking must be for private use by the Guest Group. We will not accept a Booking which is made by a Guest who organises holidays on a commercial basis and/or wishes to sub-let or otherwise rent out the Accommodation to third parties.
2. Cancellation, Booking Changes and Insurance
a) If you wish to cancel the Booking please contact us by email or letter immediately.
b) Failure to pay the balance of the Price in full not less than 56 days before the first day of the Holiday will constitute a cancellation of the Booking.
c) If You wish to cancel the Booking You must let us know by email or in writing as soon as possible and, in any event, before the first day of the Holiday. The Booking will be cancelled with effect from the day we receive Your email or written notification, subject to us deducting cancellation charges as set out in clause 2 d). We strongly recommend You and Group Guests take out holiday insurance to compensate You in these circumstances.
d) Our cancellation charges are as follows:
No. of days prior to Holiday start date: Cancellation charge
More than 56 days: Administration fee of £25 (plus the Deposit)
56 – 28 days: 50% of the Price (includes the Deposit)
Less than 30 days or after the booking start date: 100% of the Price
e) If You want to change the dates of the Holiday we will do Our best to accommodate Your request subject to that alternative date being available and provided you notify us no less than 28 days before the first day of the Holiday, as set out in the original Booking. An administration charge of £25 will applied and if the Price has been increased between the date the Booking was made and the date an alternative date is requested, the higher Price will be applied. If We cannot accommodate Your request, and You wish to cancel the Booking, Our cancellation charges as set out above will apply.
f) If we need to change or cancel the Booking due to circumstances which were unforeseen when the Booking was made including but not limited to extreme weather and/or other events beyond our control, we will endeavour to offer You a suitable alternative Booking. If we are not able to do so or if You do not accept the alternative Booking we offer, the Booking will be deemed cancelled and we will refund you the total amount you have paid us. We are not responsible for or liable to pay any compensation or expenses incurred by You as a result of a cancellation or alteration made pursuant to this clause 3 f).
g) If extreme weather or other events beyond Your control prevent You from commencing or completing the Holiday, you are still subject to these cancellation terms. We strongly recommend that You take out a travel insurance policy which covers this eventuality.
h) Please note that cancellations and refunds are not available for single Group Guests. Please note our Covid -19 terms below.
3. Check In/Out Times
Arrival: Check is from 4pm on the day of arrival.
Departure: Check out time is 10.30 am on the day of departure.
4. Code of Conduct
If any Group Guest fails to comply with the standards and behaviours set out in this clause 4 we reserve the right to require that that Group Guest leaves the premises, in which case no refund will be given for any balance of the Holiday remaining at that point.
Each Group Guest must:
a) only use the Accommodation for the purposes of the Holiday and must not enter any areas which are not included as part of the Accommodation[sh3] or are on the farm but outside the Nantseren Meadow
b) respect that Nantseren is situated on a working farm with live animals and potentially dangerous farm equipment and other hazards present.
c) use all due care and attention when using walk ways and other areas of the Accommodation and Nantseren Meadow, which may well be uneven. This includes but is not limited to the use of torches at night-time and weather appropriate footwear with adequate grip.
d) keep the Barn, Communal Kitchen, Bathhrooms and all other areas of the Accommodation and any contents clean and tidy and leave them in the same condition as found on arrival.
e) at the end of the Holiday strip the beds of bed linen and leave them on top of the beds together with used towels.
f) not use the Accommodation, or allow it to be used, for any dangerous, offensive, noisy, illegal or immoral activities. You must not cause any nuisance or annoyance to any neighbours or anyone else during the Holiday.
g) comply with all safety information provided in these Terms and at the Accomodation for use of the Wood Burner, Wild Spa Area and hot tub and all other parts of the Accommodation and the Nantseren Meadow.
h) not smoke inside any part of the Accommodation. Please note smoking includes use of vapours and/or e-cigarettes. If you smoke on the Nantseren Meadow you must dispose of any cigarette ends responsibly and must not leave the cigarette ends on the Nantseren Meadow.
i) not use candles, fireworks or Chinese lanterns in any part of the Accommodation or the Nantseren Meadow.
j) use only the fire pits and barbecue supplied, must not move them and must dispose safely of any barbecue ashes or residue.
k) not use barbeques, gas stoves, or other naked flames and cooking equipment inside any of the Tents.
l) dispose of all rubbish as instructed.
5. Use of the Wood Burning Stoves
a) Wood burning stoves are used at the risk and responsibility of Group Guests.
b) Wood burning stoves may only be used once all Group Guests have read the instructions provided next to each wood burning stove and the Guest has signed our disclaimer form.
c) The occupiers of each Tent must nominate a person within their group who will light the wood burning stove.
d) Please do not use anything other than the wood, fire-lighters and kindling that is provided by or purchased from Nantseren .
e) Children must not be allowed near lit wood burning stoves.
f) Group Guests must ensure that any fire lit in a wood burning stove is extinguished before leaving a Tent.
g) Group Guests must use the fire guard provided.
h) Do not dry clothes within two metres of wood burning stove.
6. Use of the Hot Tub
The Wild Spa Area is unattended. It is available for use between 15.00 and 22.00 and may only be used once the Guest has signed our disclaimer form for Hot Tub use on behalf of the Group Guests. Each Group Guest who uses the hot tub must read the safety information provided and will in addition comply with the following terms:
a) Hot tub is used at the risk and responsibility of Group Guests
b) Please enter the hot tub with safety in mind at all times, checking the temperature first. For adults the temperature should be below 40 degrees Celsius, for children below 32 degrees Celsius.
c) Do not bathe for longer than 20 minutes at a time.
d) Do not jump in or out or dive into the hot tub.
e) Never enter the hot tub with sharp objects.
f) Never use electrical devices in or near the hot tub.
g) Never use glass or any other breakable items within or near the hot tub.
h) Always wear appropriate clothing such as a bathing costume.
i) Never wear shoes or heals as this could cause injury and damage to the spa.
j) Will not use the hot tub when under the influence of alcohol or drugs, or when overly tired.
k) Will shower before use and will not wear any fake tan or other lotions which may cause permanent discolouration of the hot tub.
l) Will not use bubble bath, soaps, washing up liquid or any other chemicals in the hot tub.
m) Will not use the hot tub if pregnant.
n) Will not use the hot tub if feeling unwell or suffering from any medical contradiction including but not limited to heart disease, circulatory problems, diabetes, low or high blood pressure.
o) Will not use bubble bath or soaps, washing up liquid or any other chemicals in the hot tub.
p) Children under 16 years of age must be accompanied by an adult. Children under 4 should not use the hot tub. Never leave children unattended in or near a hot tub, and always consult a doctor before allowing children in a hot tub.
q) Use the gauntlets provided when adding wood to the wood burner
r) Immediately exit and seek shelter in the event of lightening or threatening weather.
6. Liability
a) Damages and Breakages
You are responsible and liable to pay for any breakages or damage which occur as a result of the use by any Group Guest of the Accommodation or its contents. Please report any such damage as soon as possible after its occurrence.
b) To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the Booking and the use by any Group Guest of the Accommodation, its contents or the Nantseren Meadow.
c) Nothing in these Terms excludes or restricts Our liability for death or personal injury resulting from any negligence or fraud on Our part.
7. Miscellaneous
a) Whilst every care is taken to provide a true and accurate description of the Accommodation and Nantseren Meadow, over time, alterations are made and some things do change. You accept that no refunds are available for such discrepancies.
b) We reserve the right to enter any part of the Accommodation or the Nantseren Meadow in the event that remedial or repair work is required.
c) Pets are not permitted.
d) Number of Guests
The maximum number of people entitled to stay at this property is 16. We will, at our discretion allow 2 further guests for payment of a surcharge of one eighth of the Price, but this must be arranged in advance and is subject to our discretion. Only those Group Guests named in the Booking are entitled to stay at Nantseren during the Holiday.
e) Severance: In the event that any of these Terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining Terms.
f) Data: Any data gathered during the course of this booking may be held only for the purposes of dealing with your booking. Please refer to our Privacy Policy.
g) Complaints
Should you have any complaint during your Holiday , please notify us immediately so that we may address it as appropriate.
h) The Booking is personal to You and You may not assign or transfer the benefit of it to any other person.
h) No-one other than You and Us shall have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the provisions of the Contract.
i) You have not relied on, and shall have no remedies for, any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms
j) The Contract and any dispute or claim arising out of or in connection with it, its subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with, the laws of England and Wales
